GENERAL ARTICLES
=================================================================
The People Have A Right To Know, (what we want them to)
by Philip Lozier 1:267/169
(*NOTE* Although a result of the past FidoNews article mentioned here,
this is in no way a rebutal to that article, as I believe that article
was based on what were believed to be the facts by the author. It is
in fact a result of the disgust I feel towards the newsmedia handling
of the issue presented in that article. Being close to home for me, I
was aware of facts that were -not- presented outside my local area. I
see it as a wake up call in respects to trusting media content.
Although based on an USA issue I am sure the jist of it could apply
almost anywhere.)
I've gotta tell you, it seems that these days you can't trust a thing
presented by the media. In a recent article right here, Shannon
Talley, a true American hero in every sense of the word, who believes
firmly in the principles of the great nation we both share, had an
article published concerning his feelings over what he thought was the
trampling on of basic civil rights back here in the USA. This was
absolutely not the case, and Mr. Talley, everybody for that matter,
should be very careful about trusting facts once they gain attention
by media from outside the local area. It wasn't Shannon's fault
though. Anybody in his position could be duped by the way our media
presents, or actually mis-represents, the facts in any given
sittuation.
The article was about a man being arrested for wearing a t-shirt that
read "give peace a chance" in the Crossgates Mall, near Albany, New
York. The allegation was that mall security targeted him like
guestapo thugs for wearing an anti-war slogan, and that he was just
minding his own business, not "speaking, chanting, raving, nor making
speaches." If this was the case, as Mr. Talley was clearly led to
believe by the CNN slot he saw, I could understand his being
infuriated! After all HE -IS- fighting overseas to protect the idea of
freedom and the rights of individuals. What -IS- he fighting for if
such injustices are being allowed to occur in his homeland?
Unfortunately, Mr. Talley was the victim of media hype and blatant
misreporting of the facts by an irresponsible news community. Being
local to where this happened, I had the benefit of seeing the local
news reports immediately after the incident occured. The glory about
local, late-breaking, media coverage is that things are reported right
after they happen, before they can get twisted, and you get more of
the real facts. I saw the report on a local television station, WRGB
Channel 6, (incidently, the first and oldest existing full time
broadcast television station), and it was reported that indeed the
gentlman in question -was- aproaching other shoppers, and he and his
son were engaged in verbal disputes with an entire group of people, of
a nature that caused at least one patron of the mall to report it to a
store security person with worries that the verbal dispute would
FIDONEWS 20-14 Page 3 7 Apr 2003
escalate. At this point, laws were already being broken, such as
harrasment of the other shoppers, and disorderly conduct. Hardly a
little peaceful innocent freedom of speach or expression thing.
Security became involved, and the guy refused to stop his activities,
he was asked to leave, refused, so he was, in accordance with New York
State Law, arrested for tresspassing.
After some discussion with Shannon on this, and him being convinced I
was mistaken, I dug for the truth. I was sickened by the articles and
reports I saw from outside this area that gave the impression that
this guy was targeted just because he was wearing a shirt with an
anti-war saying. Mostly very short blurbs that would give anybody the
wrong impression and make the owners of Crossgates Mall look like
fascist warmongers. It really boiled my blood, knowing better. I
guess leaving out a few of the true facts doesn't make it a -real-
lie, but the image of a poor peaceful guy expressing himself being
targeted sure makes for better press, huh?
The facts you ask? Well... during the course of this disgusting
search, I finally came across them. The sworn criminal complaint and
supporting deposition filed with the local court.
Anybody who wishes to view the photo copy images of these documents
can do so at http://thesmokinggun.com/archive/crossgates1.html
They entirely change the perspective on this incident, show it for
what it truly was, and absolutely show that the reports all of you saw
outside this area were a blatant case of misreporting. They also show
that the facts in Mr. Talley's article were false. Those of you who
are interested, and wonder who is "on the watch", can read them and
judge for yourself... then wonder where the focus of the watch should
be.
The actual criminal complaint clearly states that complaints of this
guy and his son aproaching and stopping other shoppers were recieved
by mall security.
The supporting deposition of an undercover detective in Macy's (The
store in front of which this occured) states that a woman aproached
her about a verbal dispute that was occuring between two men in
anti-war shirts and a crowd of people, and that the woman was
concerned how the verbal dispute was escalating.
Another supporting deposition by one of the mall security really
brings it into focus. After being notified about the dispute, he
aproached Mr. Downs (our peaceful innocent guy) and was told that he
had to stop it. He was told to leave people alone and to remove the
shirt (note* there had been an incident in January at the same mall
involving many people in anti-war shirts causing a nuisance in the
name of "peaceful protest", so concerns could be justified), Mr. Downs
refused. He was then told he would have to leave. He again refused,
absolutely refused in fact. Mr. Downs was informed that Crossgates
mall was private property, and he could be arrested if he refused to
comply. He still refused. The guard got the aid of a police officer
who tried to talk sense to the guy, to no avail. After a final
warning, Mr. Downs was brought to a police sub-station within the
FIDONEWS 20-14 Page 4 7 Apr 2003
mall, where he was handed a desk apearance ticket to apear in the
local court, and released, under the condition that he leave the mall.
Believe it or not, he refused again! He was told if he didn't leave,
he would be re-arrested for tresspassing. Do you believe that the guy
STILL refused to leave! Is it any wonder they finally put the
handcuffs on him?
Some innocent peaceful guy just going about his own business! Yea,
right. Creating a disturbance with a crowd of people, then acting in
a beligerant manner with security and police officials. Then he has
the nerve to cry -his- rights were violated. What about the rights of
the people he was arguing with? What about the rights of the people
who own the mall to have business conducted in their establishment
without their patrons being disturbed. Does one think if they walk
into a restaraunt and start walking up to tables and bothering the
customers eating their lunch, that they won't be asked to leave, and
arrested if they don't? Let's be realistic here, just for the sake of
common sense!
He should have been charged with disorderly conduct, and harrasment,
in addition to the measly tresspass they gave him. They were -nice-
to him actually... maybe his position on the judicial review board
(the guys who investigate cases of misconduct by judges) had something
to do with that. Wouldn't -you- want to be the judge hearing -that-
case?
I am of the same mind as Shannon Talley to be proud to live in a
country were we can protest without being shot in the back of our
heads, and to be able to speak freely.
The US Constitution is paramount, however, often misinterpreted.
Freedom of speech does not mean we can walk into private
establishments and force our oppinions on others, or call them names
if they disagree with us. That is called harassment.
Freedom of expression doesn't mean you can cause disturbances in
private, or public for that matter, places... that is called
disorderly conduct.
Protesting. Come on, that's common sense too... if one wishes to
protest the actions taken by a government, who do you protest to?
Well... I wouldn't think it's a bunch of shoppers who disagree with
you... what can they do about it anyway? That's just called dumb, as
well as looking for trouble. This brainiac, if he was looking to
protest, would have been better off at the State Capital for crying
out loud... only a few miles from the mall, and guess what... he had
to pass within a few blocks of it to get to the mall, being he came
from the town of Selkirk... gotta pass it. He wouldn't have got
arrested either!
I think the point is proven on this guy, and the media discredited.
Read the documents for yourself.
Every US citizen should be concerned about their civil rights, but,
along with rights, comes responsibility. Hmmm... the news media.
Their famous cry... "THE PEOPLE HAVE A RIGHT TO KNOW!" hip-hip. Where
FIDONEWS 20-14 Page 5 7 Apr 2003
is -their- responsibility? Do we have a right to know the facts, or
just what they want to tell us. Maybe just what makes the story more
interesting? I spit on the media for the coverage on this story. It
has to make you wonder just how much we see coming out of Iraq is
true. How many little details were left out? Maybe just that one
little one that adds a little more controversy to each story and leads
to follow up talk spots, with those advertisement segments for them
during each break to draw ratings to a time slot?
Does the newsmedia really think that it isn't lies just because they
left something out, no matter how it sways the story? ..."Only 30
seconds for that slot, and hey, we told the most important part of
it!" ... yea, the part -they- felt was important. Maybe the part that
causes somebody to go out into a big protest for something that didn't
really happen. Maybe the little part that causes somebody to lose
their job. Maybe the part that causes people to get into fistfights
over oppinions. Maybe the part that causes a business to shut down.
Maybe the part that causes somebody to lose a lawsuit (yea, tell me
juries don't get swayed), maybe worse.
By misrepresenting the facts, the media caused so much fuss, that the
owners of Crossgates Mall were inclined to drop the charges. Why?
Because the case had no merit? I think not. Common sense would tell
anybody it was to avoid the media frenzy that the case would have
spurred.
It also inclined them to fire a security guard... why? Because he did
something wrong? Nope. PR move, that's all. I'm sure that made his
life just wonderful. Why? Because of a public nuisance hiding behind
the pretense of his rights. Wonder how easy it will be for him to get
another job.
We should always be on the watch that our rights are never removed,
but we should also be on the watch for those who would abuse those
rights, making the ones who REALLY have their rights stepped on
discredited and not taken seriously when they should be.
People should be better educated on what their rights really are, and
what responsibilities come with them, so they aren't under false
assumptions and misguided righteousness when they stand up for what
they -think- their rights are. Being educated on ones rights will
also help them see the rebel rousers for what they really are when
they try to stir things up for their own agenda under a pretense of
-civil rights-.
The newsmedia? Ah... what to do with them. They cause more trouble
and stir more people to misguided judgements and actions than I don't
know what. What to do with them. I don't know. Their credibility is
almost non-existant in my eyes. They are truly a menace to society.
These are my oppinions along with the actual facts of this matter.
What's the point? I don't know... maybe that while on the watch, that
it is important to watch the sources that stir you to actions. Maybe
to truly know the facts before making conclusions and judgements.
Maybe that in times such as these, it is ever more important to have
ones eyes wide open at all times watching for the liars, because it
FIDONEWS 20-14 Page 6 7 Apr 2003
could be a real big lie one day that effects all of our lives forever.
I myself would have believed the hype as well if not for it being so
close to home. It's kind of scary in times like these, not knowing
what to believe. Be on the watch.
My eyes are definately opened a little bit more when it comes to the
media.
God bless all of our troops, and may they have a quick and safe
return.

Socrates
wdbonner@pacbell.net
In ancient Greece, Socrates was reputed to hold knowledge in high
esteem. One day an acquaintance met the great philosopher and said,
"Socrates, do you know what I just heard about your friend?"
"Hold on a minute," Socrates replied. "Before telling me anything I'd
like you to pass a little test. It's called the Triple Filter Test."
"Triple filter?"
"That's right," Socrates continued. "Before you talk to me about my
friend, it might be a good idea to take a moment and filter what
you're going to say.
The first filter is Truth. Have you made absolutely sure that what you
are about to tell me is true?"
"No", the man said, "actually I just heard about it and..."
"All right", said Socrates. "So you don't really know if it's true or
not. Now let's try the second filter, the filter of Goodness. Is what
you are about to tell me about my friend something good?"
"No, on the contrary..."
"So," Socrates continued, "you want to tell me something bad about
him, but you're not certain it's true. You may still pass the test
though, because there's one filter left: the filter of Usefulness. Is
what you want to tell me about my friend going to be useful to me?"
"No, not really."
"Well", concluded Socrates, "if what you want to tell me is neither
true nor good nor even useful, why tell it to me at all?"
This is why Socrates was a great philosopher and held in such high
esteem.
It also explains why he never found out his best friend was sleeping
with his wife.

The Painter
There was a tradesman, a painter called Wayne, who was very interested
in making a penny where he could, so he often would thin down paint to
make it go a wee bit further.
FIDONEWS 20-14 Page 8 7 Apr 2003
As it happened, he got away with this for some time, and eventually
the Baptist Church decided to do a big restoration job on the painting
of one of their biggest buildings. Wayne put in a bid, and because his
price was so low, he got the job.
And so he set to erecting the trestles and setting up the planks, and
buying the paint and, yes, I am sorry to say, thinning it down with
turpentine.
Well, Wayne was up on the scaffolding, painting away, the job nearly
completed when suddenly there was a horrendous clap of thunder, and
the sky opened, the rain poured down, washing the thinned paint from
all over the church and knocking Wayne clear off the scaffold to land
on the lawn among the gravestones, surrounded by telltale puddles of
the thinned and useless paint.
Wayne was no fool. He knew this was a judgment from the Almighty, so
he got on his knees and cried: "Oh, God! Forgive me! What should I
do?"
And from the thunder, a mighty voice spoke... (you're going to love
this)
"Repaint! Repaint! And thin no more!"
Ouch ...I'm outta' here! <G>

A classic with a twist
Sent in by Holger Granholm, 2:20/228
An aircraft is about to crash. There are five passengers on board, but
unfortunately only 4 parachutes.
The first passenger says "I'm Shaquille O'Neill, the best NBA
basketball player. The Lakers need me, it would be unfair to them if I
died". So he takes the first parachute and jumps.
The second passenger, Hillary Clinton, says "I am the wife of the
former President of the United States. I am also the most dedicated
woman in the world, a Senator in New York and America's potential
future President. She takes one of the parachutes and jumps.
The third passenger, George W. Bush, says " I am the President of the
United States of America. I have a huge responsibility in world
politics. And apart from that, I am the most intelligent President in
the history of the country and I have a responsibility to my people
not to die". So he takes a parachute and jumps.
The fourth passenger, the Pope, says to the fifth passenger, a ten
year old schoolboy "I am already old. I have already lived my life, as
a good person and a priest I will give you the last parachute".
The boy replies "No problem, there is also a parachute for you.
America's most intelligent President has taken my schoolbag..."

FIDONEWS INFORMATION
=================================================================
How to Submit an Article
If you wish to submit an article for inclusion in the Fidonews, here
are some guidelines, if you send it as an attached file; the preferred
method if you want reasonable control over how the published article
will appear in the Fidonews:
a) Plain ASCII text. If you could type it on your keyboard, it's
probably quite OK...
b) Put a title to the article. Put the title in two times. The first
time, on the first line, with an * before it. The second time, on
the second line, without the * and centered. This will help in the
format since the title with the * is removed and used in the index,
the second line will become the headline. On the third line, put
your name and FidoNet address, present or former. If former, you
may want to add some other address where you can be reached for
personal comments.
c) Deadline for article submission is Sunday, 12:00 UTC.
Help the Editor by following the above guides. Below are some subjects
and the file extension for the article as set in the configuration
file for the making of the Fidonews. Please help by putting the file
extension of the correct subject on the file name if known..
Ideas for Subject areas:

If you don't know or are not sure, send the article anyway. Put a .TXT
on it and I'll try to figure out where it should be in the Fidonews.
If you follow these simple guidelines, there should be little problem
in getting your article published. If your submission is too far out
of specs for the Fidonews, it will be returned to you and/or a message
sent informing you of the problem. This DOES NOT mean that your
article is not accepted. It means that there is something in it that I
can not fix and I need your help on it.
